1. Acceptance of Terms
Welcome to QR Cheetah. By accessing or using our website, services, or applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
These Terms constitute a legally binding agreement between you and Snapit Software ("Company," "we," "us," or "our"), operated by Terrell Flautt, located in Coupland, TX 78615, USA.
2. Description of Service
QR Cheetah provides dynamic and static QR code generation, management, and analytics services. Our Service allows you to:
- Create static and dynamic QR codes
- Customize QR code appearance with colors and logos
- Track QR code scans with detailed analytics
- Change dynamic QR code destinations without reprinting
- Manage QR codes through a centralized dashboard
- Generate QR codes in bulk (Enterprise plans)
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
3. User Accounts and Registration
To access certain features of the Service, you may need to create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
We reserve the right to suspend or terminate accounts that violate these Terms or that we believe, in our sole discretion, pose a risk to our Service or other users.
4. Acceptable Use Policy
You agree NOT to use the Service to:
- Violate any applicable laws or regulations
- Create QR codes linking to malware, phishing sites, or illegal content
- Generate QR codes for spam or unsolicited communications
- Create misleading or fraudulent QR codes
- Link to content that infringes intellectual property rights
- Create QR codes for harassment or illegal activities
- Abuse the analytics system with fake scans
- Circumvent security measures or rate limits
- Resell the Service without authorization
Note: Violation of our acceptable use policy may result in immediate account termination and deletion of all QR codes without refund.
5. Payment Terms
For paid subscription plans:
- Payment Processing: All payments are processed securely through Stripe. We do not store your complete payment card information.
- Subscription Billing: Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan.
- Automatic Renewal: Subscriptions automatically renew unless cancelled before the renewal date.
- Price Changes: We may change our prices with 30 days notice. Existing subscriptions will honor current pricing until renewal.
- Refunds: We offer a 30-day refund policy for annual subscriptions. Monthly subscriptions may be cancelled at any time but are non-refundable for the current billing period.
- QR Code Persistence: Upon subscription cancellation, dynamic QR codes may become inactive after the billing period ends.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Snapit Software and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of any logos, images, or content you upload to customize your QR codes. By uploading content, you represent that you have the right to use such content.
7. User Content and Data
You retain ownership of:
- QR code configurations and destination URLs
- Custom branding assets (logos, colors)
- Analytics data generated by your QR codes
By using the Service, you grant us a limited license to process your data solely for providing the Service. We may collect anonymized, aggregated scan statistics to improve our Service.
You are responsible for ensuring all destination URLs comply with applicable laws and these Terms.
8. Service Availability
We strive to maintain high availability but provide the Service on an "as-is" and "as-available" basis.
- Free Tier: No service level agreement (SLA) is provided. QR code redirects may experience occasional delays.
- Paid Tiers: We make commercially reasonable efforts to maintain uptime. Enterprise plans may include specific SLA terms.
We are not liable for any downtime that may affect QR code functionality or analytics collection.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND
- WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- WE ARE NOT RESPONSIBLE FOR LOSSES DUE TO QR CODE SCANNING FAILURES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
10. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.
Upon termination:
- Your right to use the Service ceases immediately
- Dynamic QR codes will stop redirecting
- Static QR codes remain functional (they encode data directly)
- We may delete your account and associated data after 30 days
You may terminate your account at any time by contacting us or using the account settings.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Travis County, Texas.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting the updated Terms on our website
- Updating the "Effective Date" at the top of this page
- Sending email notification for significant changes (for registered users)
Your continued use of the Service after changes constitutes acceptance of the modified Terms.
